WHO Meeting Results in Three Crucial Elements

VIVAnews - Three crucial elements are being negotiated in the Standard Material Transfer Agreement, organized by the World Health Organization (WHO), in preparation of dealing with the flu pandemic. According to adviser of Indonesian Health Minister, Widjaja Lukito, the three elements are the Term of Reference (TOR), Benefit Sharing, and Dispute Settlement.

“The negotiation is still intense”, he said on Monday, May 25.

The preparation draft was issued during a WHO meeting last week. The draft was suggested by Indonesia to cement a deal on the virus sharing mechanism aiming at more transparent, fair and equal processes between the donor and recipient countries.

The resolution requested the Director General of WHO to consider the points in the draft and facilitate them to be finalized. Ninety percent of the draft has been agreed.

Lukito also said that “There was a term of reference which hasn’t changed for 60 years." The TOR was coming from the Essential Laboratory Lab in Indonesia, he claimed.

The terminology is expected to be modified resulting in transparent and fair processes of transferred materials.

Regarding the benefit sharing, Lukito said that the developed countries have not yet agreed. “They don’t want the benefit sharing to be a legal binding,” he said.

Lukito went on by saying that the developed countries demanded that the intellectual property rights such as the sharing of reagents, diagnostic, virus tracking, vaccine candidates, building capacity for public policies, pile stock, and pricing are applied.

According to him, the negotiation will occur from May 2009 to January 2010.

The developed countries which participate in the negotiation are the United States, the EU countries, Japan, France, and Norwegia. The results of the negotiation will be presented before the WHO’s Executive Board meeting in January 2010. Health Minister Fadillah Supari is appointed Vice President I for the meeting.
